These Terms & Conditions outline the rules, responsibilities, and obligations for using the MarkMe Attendance Management Software. By using our service, you agree to the terms below.

1. Service Usage

MarkMe provides attendance management, analytics, notifications, and related digital services. Access is granted only for the subscribed period.

2. Subscription & Payment

• Yearly Subscription Fee: 10,000/- (must be paid on time; delayed payments may result in suspension of access).
• One-time Advance Fee: ₹4,000/- (non-refundable; paid before setup).
• If the subscription is canceled, full yearly payment is still due.
• No refunds for any payments.
• Renewal must be completed before expiry to avoid service interruption.
• A license certificate is issued after each annual renewal.
• Future Price Revisions: The Provider reserves the right to increase the subscription fee if hosting, maintenance, API, or operational costs rise. Any such increase will be communicated to the Client at least 6 months in advance.

3. Provider Responsibilities

• Maintain hosting, domain, backups, API configurations, and software updates.
• Provide technical support during working hours.

4. Client Responsibilities

• Use the software lawfully and ethically.
• Provide accurate data.
• Not copy, modify, resell, or attempt unauthorized access to the software.

5. Data & Privacy

• Provider will not share Client data except as required for hosting/API purposes.
• Provider is not responsible for any data loss, whether due to user error, technical issues, or unauthorized access.

6. Ownership & Licensing

• MarkMe software, code, and intellectual property belong solely to the Provider.
• Client is granted a non-transferable license valid only during the subscription period.
• Software Designed & Developed By Atharv Tambe.

7. Termination

• A 6-month prior written notice is required for cancellation.
• If canceled without notice, full yearly payment remains mandatory.
• Provider may suspend access in case of unpaid dues.
• No refunds after payment.

8. Liability

Provider is not liable for:

• Downtime caused by third-party hosting or APIs.
• Data loss due to any reason.
• Financial losses from attendance inaccuracies.

9. Governing Law

These terms are governed by the laws of India.

10. Acceptance

By signing or utilizing the software, both parties agree to all terms and conditions mentioned above.
